Terms of Service

These Terms of Service ("Terms") govern your use of the FieldPay platform, including the mobile web app, invoicing tools, and any related services (collectively, the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Who We Are

FieldPay is a South African software platform designed for tradespeople and field service operators. The Service is operated by FieldPay (Pty) Ltd ("FieldPay", "we", "us", or "our"), registered in South Africa.

You must be at least 18 years old and legally able to enter into contracts under South African law to use the Service. By registering, you confirm that the information you provide is accurate and up to date.

The Service is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted or error-free access.

5. Free and Pro Plans

The Free plan allows up to 3 invoices per calendar month. The Pro plan (R49/month or R490/year) provides unlimited invoices and additional features. Plan limits and pricing may change with 30 days' notice.

Subscriptions are billed in advance via PayFast. Payments are non-refundable except where required by the Consumer Protection Act 68 of 2008 ("CPA").

6. Cancellation

You may cancel your Pro subscription at any time from within the app. Your Pro access continues until the end of the current billing period. After cancellation, your account reverts to the Free plan and your data is retained.

7. Your Data and Invoices

You own all invoices, client data, and business information you create in FieldPay. We do not claim any intellectual property rights over your content. You are solely responsible for the accuracy of your invoices, VAT calculations, and any tax submissions to SARS. FieldPay is a tool — it does not constitute accounting, legal, or tax advice.

8. VAT and Tax

FieldPay calculates VAT at 15% where applicable. You are responsible for determining whether you are required to be VAT-registered with SARS, for submitting your VAT201 returns on time, and for ensuring all invoices comply with SARS requirements. FieldPay does not submit returns or interact with SARS on your behalf.

The FieldPay name, logo, design, and software are owned by FieldPay (Pty) Ltd. You may not copy, reverse-engineer, or create derivative works of the Service without our written permission.

11. Limitation of Liability

To the maximum extent permitted by applicable law, FieldPay is not liable for any indirect, incidental, or consequential loss arising from your use of the Service, including loss of revenue, data loss, or tax penalties. Our total liability to you in any 12-month period is limited to the subscription fees you paid to us in that period.

Nothing in these Terms limits liability for fraud, gross negligence, or any right you have under the CPA that cannot be excluded by contract.

12. Termination

You may delete your account at any time from Settings in the app. All your data will be permanently deleted. We may terminate or suspend your account if you breach these Terms, with or without notice.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you by email or via an in-app notice at least 14 days before material changes take effect. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the courts of the Eastern Cape Division, Grahamstown.
